The Supreme Court has upheld the constitutional validity of key provisions of the Insolvency and Bankruptcy Code (IBC), reaffirming the legal framework governing corporate insolvency and resolution in India. The judgment strengthens the credibility of the Code and reinforces its objective of ensuring timely resolution of distressed businesses.

The Court observed that the IBC strikes a fair balance between the interests of creditors, corporate debtors, and other stakeholders while promoting value maximization and efficient insolvency resolution. The ruling also reinforces the importance of the Committee of Creditors (CoC) and the role of the National Company Law Tribunal (NCLT) in the insolvency process.
